Terms of Service

1. Who we are
FrostBanner (the “Service”) is provided by Artem Galyeyev, sole proprietor (empresário em nome individual), NIF 247017841, Maia, Portugal (“we”, “us”). When you use the Service you enter into an agreement with us. You can contact us at support@frostbanner.com.
2. Acceptance
By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a company, you confirm that you may bind it to these Terms. If you do not agree, do not use the Service.
3. The Service
FrostBanner lets website owners show a cookie consent banner, block scripts until consent is given, send Google Consent Mode signals and keep a log of visitors' consent decisions. Features depend on your plan, as described on our pricing page.
4. Your account
- You sign in with a link sent to your email address. Keep access to that email secure; anyone who controls it can access your account.
- You may only add websites that you own or are authorised to manage.
- You must give accurate information and keep it up to date.
5. Plans, payment and Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns related to payments. Payment, taxes, invoicing and billing are governed by Paddle's Buyer Terms.
- The Free plan costs nothing and has no time limit. We may change its limits with 30 days' notice.
- Pro is a subscription billed monthly (€5.99) or yearly (€59), including VAT where applicable. It renews automatically at the end of each period until you cancel.
- You can cancel at any time through the link in your Paddle receipt or by writing to us. After cancellation, Pro features stay active until the end of the period you paid for, then your account returns to the Free plan.
- We may change prices for future periods. We will tell you at least 30 days in advance, and you can cancel before the new price applies.
- Refunds are described in our Refund Policy.
6. Your responsibilities as a website owner
You are the data controller for your website and its visitors. You are responsible for configuring the banner correctly (categories, texts, links to your cookie and privacy policies), for marking the scripts that must be blocked, and for complying with the laws that apply to your website. FrostBanner is a tool; it does not provide legal advice and does not guarantee that your website is compliant. Our processing of your visitors' data is governed by our Data Processing Agreement.
7. Acceptable use
You must not:
- use the Service for anything unlawful, fraudulent or misleading, including dark patterns that trick visitors into consenting;
- send spam or abuse the sign-in or consent endpoints;
- infringe anyone's intellectual property;
- try to access other customers' data, interfere with the security of the Service, or overload it;
- copy, resell or modify the Service except as these Terms allow.
8. Intellectual property
We own the Service, including the widget, templates, dashboard and their designs. While your account is active we give you a non-exclusive, non-transferable right to use them on your websites. You keep all rights to your content (texts, logos, settings).
9. Availability
We work to keep the Service available and secure, but we do not guarantee that it will be uninterrupted or error-free. We may change or improve features. If we remove a feature that is essential to a paid plan, we will tell you in advance and you may cancel.
10. Suspension and termination
You can stop using the Service and delete your websites at any time from the dashboard. We may suspend or close an account in case of material breach of these Terms, non-payment, fraud, a security risk, or repeated violations, normally after a warning unless the risk is urgent. When a website is deleted, its settings and consent log are deleted as described in the Data Processing Agreement.
11. Liability
To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits, lost data or regulatory fines resulting from how you configured or used the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
12. Changes to these Terms
We may update these Terms. For material changes we will notify you by email or in the dashboard at least 30 days before they apply. Continued use after that date means you accept the new Terms.
13. Law and disputes
These Terms are governed by Portuguese law. Disputes will be handled by the courts of Porto, Portugal, without prejudice to any mandatory rights you have as a consumer in your country of residence. Consumers in the EU may also use the European Commission's online dispute resolution platform.
